Abstract
PL Dla skutecznego zwalczania przestępczości służby policyjne każdego państwa muszą posiadać uprawnienia do stosowania ofensywnych metod pracy operacyjnej. Do takich metod, poza kontrolą operacyjną, należą metody oparte na prowokacji. Wśród nich najistotniejsze to zakup kontrolowany i kontrolowane wręczenie (przyjęcie) korzyści majątkowej. Choć są to metody oparte na dozwolonej przez prawo prowokacji, to pamiętać trzeba, że są to metody o największym zakresie ingerencji w konstytucyjnie chronione prawa i wolności obywatelskie. Celem artykułu jest przybliżenie metod pracy operacyjnej opartych na prowokacji. Analizując przesłanki do ich zastosowania oraz zasady związane z przebiegiem tych czynności, autor wskazuje, że prawne usankcjonowanie prowadzenia czynności opartych na prowokacji, nie daje przyzwolenia ustawodawcy na jej nieograniczone stosowanie, gdyż granice działań, przy których może być ona uznana za legalną, są jasno określone. Autor zaznacza również, że ich niewłaściwe stosowanie może mieć negatywne skutki dla dalszego procesu karnego, osób objętych zainteresowaniem służb, jak i dla funkcjonariuszy prowadzących pracę operacyjną.
EN The is no doubt that to combat crime, the Police of every country must have an eli gibility to use offensive working method. Such methods, other than operational control, include methods based on provocation. Amongst them, the most essential one is a controlled acquisition as well as controlled handing (receiving) of financial benefit. It should be noted that those methods, though based on provocation allowed by law, are the methods of the highest extent of interference with constitutional rights and civil liberty. The objective of this Article is to show the scope of operational working methods conducted with the use of provocation. Analysing the presumptions of conducting those methods, rules associated with its managing and process, the author states that the legal sanctioning of the conduct of activities based on provocation, does not give the permission for the legislator for its unlimited use, because the limits of activities in which it can be considered legal, are clearly defined. What is more, the author of this article also indicates the negative effects of wrongly used Police provocation, for subsequent criminal trial, for individuals that held attentions of the authorities, as well as for the officials themselves.
