EN The article concerns the implementation by law enforcement authorities of the search of mobile phones, and, before that, forcing their owners to unlock access to the device in Polish law and on the basis of the laws in force in the United States. These are both urgent cases, when the activities are carried out without the consent of the court or the prosecutor’s order, and the issues of what subject-object scope the supervisory authorities’ decision on the search should have. The entirety of the title issue was considered in terms of the principle of nemo se ipsum accusare tenetur, meaning that no one is obliged to provide evidence of their guilt, which is the basic guarantee of the right of defence. The research issue required an explanation of the legal nature of the digital traces collected on the phone, the factual and legal basis for the search and the request to provide authorization data or the use of human biometric identifiers to unlock access. The provisions of the Polish Code of Criminal Procedure and the jurisprudence of American courts in force in this respect were characterized and the views of the doctrine were referred to. The conclusions drawn from the analysis are included in the summary of the article.
