Abstract
EN This article discusses the principle of trust of participants in administrative proceedings towards public authorities. It attempts to analyze the jurisprudence of administrative courts regarding the conduct of public administration bodies aimed at building trust in public authorities, the behavior of bodies resulting in a lack of trust in their actions, the purpose of this principle and its relation to other general principles of administrative proceedings. The question is whether the implementation of the principle of trust of a party to administrative proceedings in public authority ensures the legal security of an individual.
PL Niniejszy artykuł porusza tematykę zasady zaufania uczestników postępowania administracyjnego do władzy publicznej. Podejmuje próbę analizy orzecznictwa sądów administracyjnych w zakresie sposobu postępowania przez organy administracji publicznej zmierzającego do budowania zaufania do władzy publicznej, zachowań organów wpływających na brak zaufania do ich działania oraz celu tej zasady i jej odniesienia do innych zasad ogólnych postępowania administracyjnego. Postawione zostaje pytanie czy realizacja zasady zaufania strony postępowania administracyjnego do władzy publicznej zapewnia bezpieczeństwo prawne jednostki.
